The terms, in plain English.
These terms cover this website. They do not cover work we do for you. If we are working together, the engagement letter you signed is the agreement, and where it and this page disagree, the engagement letter wins.
Using this site
You are welcome to read it, share it and quote it with attribution. You may not scrape it at a rate that degrades it for anyone else, attempt to break into it, or reproduce it as your own site. It is provided as it is: we take availability seriously and publish our performance audits, but we do not promise uninterrupted service.
What is on it, and what it is worth
The words, design, code, photographs and case studies here are ours or our clients', and are protected accordingly. Client names and work appear with permission. Nothing on this site is a quotation, an offer, or professional advice specific to your situation. Service descriptions say what we typically do, and payment terms shown against them describe the shape of the fee, not a price. A price exists only in a written proposal addressed to you.
Measured claims
Where we publish numbers about performance or accessibility, they come from Lighthouse runs we record with the date they were taken, and they describe the pages measured at that moment. Your own run, on a different device or network, will differ. We re-measure rather than restate.
Working with us
Emailing us or calling us does not create an engagement, and neither does a proposal on its own. Work begins when a written engagement is signed and its opening payment terms are met. Scope, timeline, fees, approval gates and confidentiality all live in that document.
Liability
To the extent the law allows, we are not liable for loss arising from your use of this website or from anything you decide on the basis of it. Nothing here limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence.
Third-party links
We link to client sites and to our profiles elsewhere. We do not control those sites and are not responsible for what they contain or how they treat your data.
Changes
We may update these terms. The date at the top shows when they last moved, and the current version is the one that applies.
Law and jurisdiction
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from them.
