Welcome to InPlace Creates. These Terms and Conditions govern your use of our services and website. By engaging our services or visiting our site, you agree to abide by the terms outlined below.

1. Scope of Services

InPlace Creates provides end-to-end creative services across four core pillars:

    Branding & Identity Design - logos, visual systems, brand guidelines, and launch assets
  • 2
    Campaigns & Storytelling - photography, videography, advertising, and social media campaigns
  • 3
    Digital Experiences (Web & Media) - website design, UX/UI, prototyping, and media production
  • 4
    Creative Systems & Strategy - organizational workflows, creative consulting, and capacity building

2. Engagement & Payment Terms

    All services begin after written confirmation and/or signing of a proposal or service agreement.
  • 2
    A 50% deposit is required before project kickoff unless otherwise stated.
  • 3
    Full payment is due upon project delivery or milestone completion, as agreed.
  • 4
    Late payments may incur a 10% fee after 14 days past due.

3. Ownership & Licensing

    Clients own full rights to final, approved deliverables upon complete payment.
  • 2
    InPlace retains the right to showcase work in its portfolio, social platforms, and promotional materials unless agreed otherwise in writing.

    Drafts, concepts, and unused work remain the intellectual property of InPlace.

4. Revisions & Approvals

    Each service includes up to 2 rounds of revisions unless otherwise specified.
  • 2
    Additional revisions will be billed at our hourly or project rate.
  • 3
    Client delays in feedback exceeding 7 days may impact delivery timelines.

5. Cancellations & Refunds

    Either party may cancel before final delivery with written notice.

    Deposits are non-refundable once work has commenced.

    InPlace reserves the right to terminate any engagement due to breach, non-payment, or unethical conduct.

6. Client Responsibilities

    Clients are responsible for providing accurate, timely information and materials.
  • 2
    Delays caused by client inaction may result in revised deadlines or additional charges.

7. Confidentiality

We respect your confidentiality. Any non-public information shared during a project will be treated with discretion and not shared without consent.

8. Limitation of Liability

InPlace will not be liable for indirect or consequential damages arising from the use of our work. Total liability shall not exceed the amount paid for the service in question.

9. Third-Party Tools and Services

We may use third-party platforms (e.g., Framer, Canva, Google Drive) in delivering work. Clients agree to their terms where applicable.

10. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved under Kenyan jurisdiction.

11. Updates to Terms

InPlace may revise these Terms occasionally. Continued use of our services constitutes acceptance of updated terms.
